Can a person file bankruptcy or is it just for corporations?

Hi, I’m Robert Geller. I am a consumer bankruptcy attorney in the Tampa Bay area.

I want to talk to you about whether an individual can file a bankruptcy or if only corporations can. And whether it’s really that complicated to file a bankruptcy for an individual.

I have heard some people say they didn’t know that individuals can file bankruptcy because we only hear about corporate bankruptcies. One of the biggest ones filed lately is Hertz Rent-A-Car file bankruptcy. Some people don’t realize that an individual – one person – can file. They can file either a chapter seven or a chapter 13 or even an individual chapter 11.

It’s relatively easy to do it. I give them a little bit of homework. I have my staff assigned to them. They work through their homework. There are some documents to complete. They can fill these out at home electronically.

From there, we do all the work for them. We prepare the bankruptcy petition for them, which is about 60 pages. We go to court with them, we get their discharge, and we assist them with rebuilding their credit. Also, we rebuild and we review their credit report.

Once the initial paperwork is completed, it’s a pretty simple procedure. I’m attorney Robert Geller and I want to help you build a bridge to a brighter future.
